Marion County Probate Estate Records
When someone dies without a will, the estate is intestate and Alabama law controls distribution. The county page gives spouse-share examples. A spouse may receive the whole estate when there is no surviving issue or parent. Other family structures use stated dollar amounts and shares. The balance may pass by priority to issue, parents, siblings, and more remote family.
Administration includes control of assets, an inventory within 45 days, a bond based on personal property and estimated income, and Letters of Administration. Claims and expenses generally delay division for at least six months. The court must approve personal representative fees unless all interested people agree. Prior authority may be needed to abandon an asset or sell real estate.

Marion County Probate Recovery Notices
Act 2019-489 requires notice to the Alabama Medicaid Agency when probate estate proceedings and Small Estates Act matters begin. A personal representative or person filing the petition must provide notice. Payment of sixth-order claims and summary distribution cannot proceed until proof is filed and Medicaid responds on time. The rule took effect September 1, 2019.
This notice does not prove that Medicaid has a valid claim in every estate. The probate file may show the notice and proof, while later records show the response and result.
Restricted Marion Probate Records
Many recorded documents and probate cases are public, but not every detail is open. Guardianship and conservatorship files can contain medical, financial, or personal facts. Mental-health material and information about minors may be protected. A sealed record is not available through routine search unless law or court order permits access.
Marion County began digital scanning for recorded documents in 2007. Older records may require staff help. County history traces the seat of justice from Military Ford and Pikeville to Hamilton, where a courthouse was built in 1883. That history matters when a genealogical or land record is absent from a modern index.
